SUMMARY:  Plaintiff alleges that he was sexually molested by an employee while residing at the ACME Children’s Home from age 13 to age 16.  Plaintiff alleged that the ACME Children’s Home was negligent in its supervision of its employee.  Defendants denied that the sexual abuse occurred and argued that the plaintiff did not file his lawsuit until age 22, well beyond the two-year statute of limitations.  Plaintiff responded that the memory of the abuse was repressed until he had an opportunity to review his counseling records.  However, the defendants called a priest, social worker and doctor to the stand who all testified that the plaintiff told them about the abuse while the statute of limitations was running.  Plaintiff himself admitted on the stand he did briefly remember the abuse from time to time but then would quickly put it out of his memory.
